Privacy Policy

Introduction

This policy is established to guide 7123019 Canada Inc. DBA Etlas Freight in using SMS and MMS communication channels in compliance with the rules and guidelines set forth by RingCentral, mobile carriers such as T-Mobile and AT&T, and in accordance with legal requirements. The policy covers the use of SMS and MMS through the RingCentral App, third-party providers, and APIs. 

Policy Overview

 

  • Adherence to Carrier Guidelines: All SMS/MMS messages must conform to the Short Code Monitoring Handbook, T-Mobile’s Code of Conduct, AT&T’s Code of Conduct, and any additional carrier-specific guidelines.
  • Legal Compliance: Employees must follow all relevant laws and regulations and consult legal advisors to understand obligations specific to our messaging.
  • Consent and Opt-In/Opt-Out Management: Explicit, written consent must be obtained and logged before sending SMS/MMS messages. Opt-out mechanisms must be clear and functional, adhering strictly to CTIA guidelines.

Message Content and Volume

 

  • Enhanced Business SMS: No more than 50 messages per originating number per minute unless using High Volume SMS solutions which allow higher rates.
  • Prohibited Content: Strictly avoid messages related to prohibited campaigns such as loan advertisements, work from home schemes, political messages, and others as listed by RingCentral.
  • Automated Messaging: Only send automated messages from numbers linked to a TCR campaign and with explicit, logged consent.

Opt-In and User Consent

 

  • Obtaining Consent: Use double opt-in mechanisms wherever possible. Consent must be specific to the campaign and logged.
  • Marketing Messages: Ensure that marketing or promotional messages only go to recipients who have given express prior written consent.

Prohibited Campaigns and Content

  •  Restrictions: Follow detailed restrictions on specific types of businesses and message content as outlined by RingCentral, including but not limited to advertisements for controlled substances, gambling, and certain financial services. 

Monitoring and Enforcement

 

  • Regular Audits: Conduct regular reviews of SMS/MMS usage to ensure compliance with this policy and carrier requirements.
  • Employee Training: Provide ongoing training for all employees involved in the drafting or sending of SMS/MMS messages.
  • Penalties for Non-Compliance: Address violations of this policy with disciplinary action, which could include termination, and address potential legal and carrier-imposed penalties.

Opt-In Language and Procedures

 

  • Explicit Consent: Ensure that the opt-in language on your website requires users to actively check an unchecked box to give their consent for SMS communications, which is a compliance requirement.
  • Clarity and Accessibility: Make the opt-in language clear about what the user is signing up for, including the type of messages they will receive and how frequently.

Privacy Policy Enhancements

 

  • Detailed Information Handling: Expand the privacy policy section to detail how personal information, especially phone numbers, is collected, used, and protected.
  • No Sharing of SMS Data: Explicitly state that SMS opt-ins and associated phone numbers will not be shared with any third parties.
  • Visibility of Policy: Ensure that the privacy policy is easily accessible from all parts of your website, ideally linked from both the top and bottom of the website pages.

Terms of Service for SMS Communications

 

  • Comprehensive Details: Include a section in your privacy policy or as a standalone document that outlines the types of SMS communications subscribers may receive, how to opt-out, and what charges may apply.
  • Message Examples: Provide specific examples of the types of messages subscribers might receive to set clear expectations.

Documentation and Compliance Tracking

 

  • Logging Consent: Implement mechanisms to log when and how consent was obtained from each subscriber, to comply with carrier requirements and potentially review by RingCentral.
  • Handling Opt-Outs: Ensure there are procedures in place to quickly and efficiently process opt-out requests.

Policy Updates

  •  Revisions: This policy will be reviewed and updated regularly to reflect changes in carrier policies, legal requirements, and company operations. 

Acknowledgment

  •  Employee Responsibility: All employees must acknowledge that they have read, understood, and agreed to comply with this SMS/MMS Compliance Policy.
